Provenance Music – Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Provenance Music platform ("the Service"), operated by Provenance Music ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms.

2. Description of Service

Provenance Music provides a songwriting platform that records user activity and generates a structured history of the creative process for informational and evidential purposes.

The Service is provided on an "as is" and "as available" basis.

3. Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account

We reserve the right to suspend or terminate accounts where misuse or abuse is detected.

4. User Content

You retain ownership of any content you create using the Service.

By using the Service, you grant us a limited licence to:

  • Store
  • Process
  • Display

your content solely for the purpose of providing the Service.

You are solely responsible for the content you create and store.

5. No Legal Guarantee

The Service is designed to assist in recording the creation process of musical works. However:

  • We do not guarantee that any data, records, or outputs generated by the Service will be accepted as legal proof of authorship or ownership in any jurisdiction.
  • The Service does not constitute legal advice.

You are responsible for seeking independent legal advice where required.

6. Plans, Pricing, and Changes

We may:

  • Introduce, modify, or remove pricing plans
  • Change features included in any plan
  • Introduce new charges

at any time, at our sole discretion.

We will make reasonable efforts to notify users of material changes, but continued use of the Service constitutes acceptance of any such changes.

7. Availability and Changes to Service

We reserve the right to:

  • Modify or discontinue any part of the Service
  • Restrict access
  • Introduce new features or remove existing features

at any time without notice.

We do not guarantee uninterrupted or error-free operation.

8. Data Storage and Loss

While we take reasonable measures to protect data, you acknowledge and agree that:

  • We do not guarantee the availability, integrity, or preservation of any data stored on the Service
  • Data may be lost, corrupted, or inaccessible due to:

    • Other unforeseen events

You are responsible for maintaining your own backups of any important content.

to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided without warranties of any kind
  • We shall not be liable for:
    • Loss of data
    • Loss of profits
    • Loss of business
    • Reputational damage
    • Any indirect, incidental, or consequential damages

arising from the use of or inability to use the Service.

Our total liability, if any, shall not exceed the amount paid by you for the Service in the preceding 12 months.

11. Indemnity

You agree to indemnify and hold harmless Provenance Music from any claims, damages, or liabilities arising from:

  • Your use of the Service
  • Your content
  • Any breach of these Terms

12. Termination

We may suspend or terminate access to the Service at any time, without liability, if:

  • You breach these Terms
  • We discontinue the Service

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland.
